A process made accessible to all

MITIS IUDEX DOMINUS IESUS · MMXV

On 15 August 2015, the Holy Father Francis issued an apostolic letter entitled "Mitis Iudex Dominus Iesus", which introduced a series of reforms aimed at making marriage annulment proceedings more accessible and swift, in response to the need of many faithful to live their beliefs in freedom despite the difficulties of obtaining the annulment of their marriage.

A shorter process was introduced for certain personal circumstances existing at the moment of contracting marriage which, in themselves, are sufficiently evident to sustain the nullity of that marriage: unforeseen pregnancy, lack of use of reason, error determining the will, obstinate persistence in an extramarital relationship…

It was further established that a double conforming decision on the nullity of the marriage is no longer required for the parties to be admitted to a new canonical marriage: the moral certainty reached by the first judge in his sentence is itself sufficient to grant the nullity.

The grounds for requesting an annulment

Unlike civil divorce, a canonical annulment does not dissolve a marriage; rather, owing to the absence of certain essential requirements at the moment it was contracted, it declares that the marriage never existed as a valid sacramental bond.

Canonical marriage is an indissoluble bond which requires certain essential conditions in order to be considered valid, such as: free and full consent, the capacity to assume matrimonial responsibilities, and the absence of canonical impediments (consanguinity, a prior unannulled marriage, lack of minimum age, impotence…), among others.
